US judge dismisses Maryland bid to protect Obama healthcare plan USA News Al Jazeera

Maryland had tried to protect the healthcare law known as Obamacare, or the Affordable Care Act, but failed in court.

A US judge has thrown out the state of Marylands lawsuit seeking to protect the healthcare law known as Obamacare in a ruling that also sidestepped a decision on whether President appointment of Matthew Whitaker as acting attorney general was lawful.

In a win for the Republican president, Baltimore based US District Judge Ellen Hollander ruledáon FridayáMaryland had failed to show that the Trump administration is likely to terminate enforcement of the 2010 law, officially called the

The claim made by Maryland Attorney General Brian Frosh, a Democrat, "consists of little more than supposition and conjecture about President Trumps possible actions",áHollander wrote.

"In effect, the state proclaims that the But, falling acorns, even several of them, do not amount to a falling sky," the judge added.

Trumps administration has taken several steps to undermine Obamacare after Congress failed in Republican efforts to by Trumps Democratic predecessor .

Frosh said in a statement that Hollanders decision does not end his effort to defend the law.

"We will resume this litigation immediately if the president breaks his promise of continued enforcement," said Frosh, who is pursuing separate litigation accusing Trump of violating an anti corruption provision of the Constitution called the emoluments clause.

By tossing the Obamacare lawsuit, Hollander avoided having to decide on the lawfulness of Whitakers appointment.

However, the judge did say Maryland had presented "sound arguments" in support of its contention that Deputy Attorney General Rod Rosenstein should have become acting attorney general when Trump fired Jeff Sessions as theáattorney generaláin November.

Hollander noted that the Supreme Court recently rejected a similar challenge to the appointment of Whitaker, a Trump loyalist who has been criticised by Democrats, and that other courts have found he was lawfully appointed.

Whitaker remains acting attorney general, though Trump has nominated William Barr, who previously held the post, as attorney general, the top US law enforcement official.

The lawsuit asked Hollander to declare Obamacare constitutional. The case arose against the backdrop of a December ruling US District Judge Reed OConnor in Fort Worth.

That ruling found that the Affordable Care Act was unconstitutional following revisions to the tax code made by Congress, which removed an Obamacare penalty for failing to obtain health insurance.

The law was challenged by a group of states including Texas. That decision is now on appeal, with the law remaining in effect in the meantime.

Cricket fans looking for tickets on sites like Viagogo and StubHub are being regularly encouraged to book them quickly, with the site sending out alerts on the screen claiming that more than 1,000 people are looking for the same tickets and they are 'selling fast'

This suggests there is an active market for resold tickets, despite organisers of the ICC Cricket World Cup stating that 'tickets are strictly non-transferable to any third party' and claiming that they are working hard on enforcement

A spokesman for the World Cup, which runs from 30 May to 14 July in England and Wales, said: 'We are working closely with lawyers to identify secondary ticket sites which are infringe our terms and conditions

We are taking appropriate enforcement action against them as required.' There is an official pathway for reselling tickets through the Cricket World Cup website, but no tickets are currently available on that platform

A spokesman for Viagogo told the BBC: 'Viagogo is a marketplace and doesn't buy or sell tickets

Viagogo provides a platform for third party sellers to sell tickets to event goers

'Event organisers sometimes make claims that they will deny entry to people who have purchased resold tickets

These types of entry restrictions are highly unfair and in our view, unenforceable and illegal

' They added: 'All tickets on Viagogo are valid and it is perfectly legal to resell a ticket or give it to someone else if you want to
